第四十七条 / Article 47
饲料、饲料添加剂经营者有下列行为之一的，由县级人民政府饲料管理部门责令改正，没收违法所得和违法经营的产品，违法经营的产品货值金额不足 1 万元的，并处 2000 元以上 2 万元以下罚款，货值金额 1 万元以上的，并处货值金额 2 倍以上 5 倍以下罚款；情节严重的，责令停止经营，并通知工商行政管理部门，由工商行政管理部门吊销营业执照；构成犯罪的，依法追究刑事责任：
（一）对饲料、饲料添加剂进行再加工或者添加物质的；
（二）经营无产品标签、无生产许可证、无产品质量检验合格证的饲料、饲料添加剂的；
（三）经营无产品批准文号的饲料添加剂、添加剂预混合饲料的；
（四）经营用国务院农业行政主管部门公布的饲料原料目录、饲料添加剂品种目录和药物饲料添加剂品种目录以外的物质生产的饲料的；
（五）经营未取得新饲料、新饲料添加剂证书的新饲料、新饲料添加剂或者未取得饲料、饲料添加剂进口登记证的进口饲料、进口饲料添加剂以及禁用的饲料、饲料添加剂的。
Where a feed or feed additive operator commits any of the following acts, the feed administration department of the county-level people's government shall order correction, confiscate the illegal gains and illegally operated products; where the value of the illegally operated products is less than RMB 10,000, a fine of not less than RMB 2,000 but not more than RMB 20,000 shall be imposed concurrently; where the value is RMB 10,000 or more, a fine of not less than 2 times but not more than 5 times the value shall be imposed concurrently; where the circumstances are serious, the operator shall be ordered to cease operation, and the industrial and commercial administration department shall be notified to revoke the business licence; where a crime is constituted, criminal liability shall be investigated in accordance with the law:
(1) Reprocessing feed or feed additives or adding substances to them;
(2) Operating feed or feed additives without a product label, production licence or product quality inspection certificate;
(3) Operating feed additives or additive premixes without a product approval number;
(4) Operating feed produced using substances other than those listed in the catalogues of feed materials, feed additive varieties and medicated feed additive varieties published by the administrative department for agriculture under the State Council;
(5) Operating new feeds or new feed additives that have not obtained a new feed or new feed additive certificate, or imported feed or imported feed additives that have not obtained a feed or feed additive import registration certificate, or operating prohibited feeds or feed additives.
