Article 47 — Penalty for Operator Illegal Acts (第四十七条)
Article 47 (第四十七条) of 《饲料和饲料添加剂管理条例》 (Regulation on the Administration of Feed and Feed Additives) penalises a feed or feed additive operator (经营者) committing any of the acts below, by the county-level feed administration department (县级人民政府饲料管理部门): order correction, confiscate illegal gains and illegally operated products.
Penalty tiers:
- Where the value of the illegally operated products is less than RMB 10,000 (货值金额不足 1 万元): a concurrent fine of RMB 2,000–20,000 (2000 元以上 2 万元以下).
- Where the value is RMB 10,000 or more (货值金额 1 万元以上): a concurrent fine of 2–5 times the value (货值金额 2 倍以上 5 倍以下).
- Where circumstances are serious: the operator is ordered to cease operation; the industry and commerce administration department is notified to revoke the business licence; criminal liability is pursued where a crime is constituted.
Five violating acts (一)–(五):
- Reprocessing feed / feed additives or adding substances (再加工或者添加物质).
- Operating feed / feed additives without a product label, production licence, or product quality inspection certificate (无产品标签、无生产许可证、无产品质量检验合格证).
- Operating feed additives or additive premixes without a product approval number (无产品批准文号).
- Operating feed produced with substances outside the three State-Council catalogues — 《饲料原料目录》, 《饲料添加剂品种目录》, 《药物饲料添加剂品种目录》.
- Operating new feeds / new feed additives without the new feed or new feed additive certificate, imported feed / imported feed additives without a feed or feed additive import registration certificate (饲料、饲料添加剂进口登记证), or prohibited feeds / feed additives.
