饲料、饲料添加剂生产企业不依照本条例规定实行采购、生产、销售记录制度或者产品留样观察制度的，由县级以上地方人民政府饲料管理部门责令改正，处 1 万元以上 2 万元以下罚款；拒不改正的，没收违法所得、违法生产的产品和用于违法生产饲料的饲料原料、单一饲料、饲料添加剂、药物饲料添加剂、添加剂预混合饲料以及用于违法生产饲料添加剂的原料，处 2 万元以上 5 万元以下罚款，并可以由发证机关吊销、撤销相关许可证明文件。
饲料、饲料添加剂生产企业销售的饲料、饲料添加剂未附具产品质量检验合格证或者包装、标签不符合规定的，由县级以上地方人民政府饲料管理部门责令改正；情节严重的，没收违法所得和违法销售的产品，可以处违法销售的产品货值金额 30% 以下罚款。
Where a feed or feed additive production enterprise fails to implement the purchase, production and sales record system or the product retention-sample observation system in accordance with the provisions of this Regulation, the feed administration department of the local people's government at or above the county level shall order correction and impose a fine of not less than RMB 10,000 but not more than RMB 20,000; where correction is refused, the illegal gains, the illegally produced products, and the feed materials, single feeds, feed additives, medicated feed additives, additive premixes and raw materials used for the illegal production of feed and feed additives shall be confiscated, and a fine of not less than RMB 20,000 but not more than RMB 50,000 shall be imposed, and the licence-issuing authority may revoke the relevant licence documents.
Where feed or feed additives sold by a feed or feed additive production enterprise are not accompanied by a product quality inspection certificate, or where the packaging or label does not comply with the provisions, the feed administration department of the local people's government at or above the county level shall order correction; where the circumstances are serious, the illegal gains and the illegally sold products shall be confiscated, and a fine of not more than 30% of the value of the illegally sold products may be imposed.
