Article 45 / 第四十五条 — Penalty for Failure to Implement Record / Sample-Retention Systems
Article 45 (第四十五条) penalizes failures in record-keeping, sample retention, and certificate/labelling compliance.
Record and sample-retention failure. Where a production enterprise fails to implement the purchase, production and sales record system (采购、生产、销售记录制度) or the product retention-sample observation system (产品留样观察制度) as required by this Regulation, the feed administration department of the local people's government at or above the county level (县级以上地方人民政府饲料管理部门) shall order correction and impose a fine of not less than RMB 10,000 but not more than RMB 20,000 (处 1 万元以上 2 万元以下罚款). Where correction is refused (拒不改正的), the illegal gains, illegally produced products, and the relevant feed materials and raw materials shall be confiscated, a concurrent fine of not less than RMB 20,000 but not more than RMB 50,000 (处 2 万元以上 5 万元以下罚款) shall be imposed, and the licence-issuing authority (发证机关) may revoke the relevant licence documents (吊销、撤销相关许可证明文件).
Missing certificate or non-compliant packaging/label. Where the enterprise sells feed or feed additives not accompanied by a product quality inspection certificate (未附具产品质量检验合格证) or where the packaging or label does not comply with the provisions (包装、标签不符合规定), the department shall order correction. Where the circumstances are serious (情节严重的), the illegal gains and illegally sold products shall be confiscated, and a fine of not more than 30% of the value of the illegally sold products (违法销售的产品货值金额 30% 以下罚款) may be imposed.
