Article 42 (의약품등의 수입허가 등, Import Approval of Medicinal Products etc.) requires Ministry of Food and Drug Safety approval for importing medicinal products, which covers imported veterinary drugs and vaccines.
Article 42 — Import approval of medicinal products
- (1) A person who intends to import medicinal products (의약품등) as a business must file an import-business report with the Minister of Food and Drug Safety (식품의약품안전처장) and obtain, for each item, the Minister's approval or file a report, as prescribed by Prime Ministerial Ordinance — "제42조(의약품등의 수입허가 등) ①의약품등의 수입을 업으로 하려는 자는 총리령으로 정하는 바에 따라 식품의약품안전처장에게 수입업 신고를 하여야 하며, 총리령으로 정하는 바에 따른 품목마다 식품의약품안전처장의 허가를 받거나 신고를 하여야 한다. 허가받은 사항 또는 신고한 사항을 변경하려는 경우에도 또한 같다." - (2) Notwithstanding paragraph (1), the Minister of National Defense or a person who has filed an import-business report under the first sentence of paragraph (1) (hereinafter "importer") may import medicinal products without obtaining or reporting item-by-item approval under paragraph (1) where any of the following applies — "제1항에도 불구하고 국방부장관 또는 제1항 전단에 따라 수입업 신고를 한 자(이하 “수입자”라 한다)는 다음 각 호의 어느 하나에 해당하는 경우에는 해당 의약품등에 대하여 제1항에 따른 품목별 허가를 받거나 신고를 하지 아니하고 수입할 수 있다." One such case is where the Minister of National Defense, to urgently use for military purposes medicinal products not domestically produced, imports them after prior consultation with the Minister of Food and Drug Safety on items and quantities — "국방부장관이 긴급히 군사 목적에 사용하기 위하여 국내에서 생산되지 아니하는 의약품등을 미리 식품의약품안전처장과 품목 및 수량에 대한 협의를 거쳐 수입하려는 경우."
