第五十二条 / Article 52
养殖者有下列行为之一的，由县级人民政府饲料管理部门没收违法使用的产品和非法添加物质，对单位处 1 万元以上 5 万元以下罚款，对个人处 5000 元以下罚款；构成犯罪的，依法追究刑事责任：
（一）使用未取得新饲料、新饲料添加剂证书的新饲料、新饲料添加剂或者未取得饲料、饲料添加剂进口登记证的进口饲料、进口饲料添加剂的；
（二）使用无产品标签、无生产许可证、无产品质量标准、无产品质量检验合格证的饲料、饲料添加剂的；
（三）使用无产品批准文号的饲料添加剂、添加剂预混合饲料的；
（四）在饲料或者动物饮用水中添加饲料添加剂，不遵守国务院农业行政主管部门制定的饲料添加剂安全使用规范的；
（五）使用自行配制的饲料，不遵守国务院农业行政主管部门制定的自行配制饲料使用规范的；
（六）使用限制使用的物质养殖动物，不遵守国务院农业行政主管部门的限制性规定的；
（七）在反刍动物饲料中添加乳和乳制品以外的动物源性成分的。
在饲料或者动物饮用水中添加国务院农业行政主管部门公布禁用的物质以及对人体具有直接或者潜在危害的其他物质，或者直接使用上述物质养殖动物的，由县级以上地方人民政府饲料管理部门责令其对饲喂了违禁物质的动物进行无害化处理，处 3 万元以上 10 万元以下罚款；构成犯罪的，依法追究刑事责任。
Where an animal husbandry operator commits any of the following acts, the feed administration department of the county-level people's government shall confiscate the illegally used products and the illegally added substances, and impose a fine of not less than RMB 10,000 but not more than RMB 50,000 on the entity and a fine of not more than RMB 5,000 on the individual; where a crime is constituted, criminal liability shall be investigated in accordance with the law:
(1) Using new feeds or new feed additives that have not obtained a new feed or new feed additive certificate, or using imported feed or imported feed additives that have not obtained a feed or feed additive import registration certificate;
(2) Using feed or feed additives without a product label, production licence, product quality standard or product quality inspection certificate;
(3) Using feed additives or additive premixes without a product approval number;
(4) Adding feed additives to feed or animal drinking water without complying with the feed additive safe-use norms formulated by the administrative department for agriculture under the State Council;
(5) Using self-prepared feed without complying with the self-prepared feed use norms formulated by the administrative department for agriculture under the State Council;
(6) Using restricted substances to raise animals without complying with the restrictive provisions of the administrative department for agriculture under the State Council;
(7) Adding animal-derived ingredients other than milk and dairy products to ruminant feed.
Where substances prohibited by the administrative department for agriculture under the State Council, or other substances with direct or potential harm to human health, are added to feed or animal drinking water, or where the above-mentioned substances are directly used to raise animals, the feed administration department of the local people's government at or above the county level shall order the harmless treatment of animals fed with prohibited substances, and impose a fine of not less than RMB 30,000 but not more than RMB 100,000; where a crime is constituted, criminal liability shall be investigated in accordance with the law.
