第五十一条 / Article 51
饲料、饲料添加剂生产企业、经营者有下列行为之一的，由县级以上地方人民政府饲料管理部门责令停止生产、经营，没收违法所得和违法生产、经营的产品，违法生产、经营的产品货值金额不足 1 万元的，并处 2000 元以上 2 万元以下罚款，货值金额 1 万元以上的，并处货值金额 2 倍以上 5 倍以下罚款；构成犯罪的，依法追究刑事责任：
（一）在生产、经营过程中，以非饲料、非饲料添加剂冒充饲料、饲料添加剂或者以此种饲料、饲料添加剂冒充他种饲料、饲料添加剂的；
（二）生产、经营无产品质量标准或者不符合产品质量标准的饲料、饲料添加剂的；
（三）生产、经营的饲料、饲料添加剂与标签标示的内容不一致的。
饲料、饲料添加剂生产企业有前款规定的行为，情节严重的，由发证机关吊销、撤销相关许可证明文件；饲料、饲料添加剂经营者有前款规定的行为，情节严重的，通知工商行政管理部门，由工商行政管理部门吊销营业执照。
Where a feed or feed additive production enterprise or operator commits any of the following acts, the feed administration department of the local people's government at or above the county level shall order the cessation of production or operation, confiscate the illegal gains and the illegally produced or operated products; where the value of the illegally produced or operated products is less than RMB 10,000, a fine of not less than RMB 2,000 but not more than RMB 20,000 shall be imposed concurrently; where the value is RMB 10,000 or more, a fine of not less than 2 times but not more than 5 times the value shall be imposed concurrently; where a crime is constituted, criminal liability shall be investigated in accordance with the law:
(1) In the production or operation process, using non-feed or non-feed-additive to pass off as feed or feed additive, or using one type of feed or feed additive to pass off as another type of feed or feed additive;
(2) Producing or operating feed or feed additives that have no product quality standard or that fail to meet the product quality standard;
(3) Producing or operating feed or feed additives that are inconsistent with the contents indicated on the label.
Where a feed or feed additive production enterprise commits the acts prescribed in the preceding paragraph and the circumstances are serious, the licence-issuing authority shall revoke the relevant licence documents; where a feed or feed additive operator commits the acts prescribed in the preceding paragraph and the circumstances are serious, the industrial and commercial administration department shall be notified to revoke the business licence.
