第三十八条 / Article 38
国务院农业行政主管部门、县级以上地方人民政府饲料管理部门或者其他依照本条例规定行使监督管理权的部门及其工作人员，不履行本条例规定的职责或者滥用职权、玩忽职守、徇私舞弊的，对直接负责的主管人员和其他直接责任人员，依法给予处分；直接负责的主管人员和其他直接责任人员构成犯罪的，依法追究刑事责任。
Where the administrative department for agriculture under the State Council, the feed administration departments of local people's governments at or above the county level, or other departments and their staff that exercise supervision and administration powers in accordance with the provisions of this Regulation, fail to perform the duties prescribed by this Regulation, or abuse their powers, neglect their duties, or engage in malpractices for personal gain, the directly responsible person in charge and other directly responsible personnel shall be punished in accordance with the law; where the directly responsible person in charge and other directly responsible personnel constitute a crime, criminal liability shall be investigated in accordance with the law.
